Eligibility

• The App and website are intended for individuals aged 18 and older. By using wadaCrush, you confirm that you meet this age requirement and have the legal capacity to agree to these Terms.
• This age requirement applies equally to the mobile App and the website.

Purpose of the App

• wadaCrush is designed to foster meaningful and organic relationships between known individuals.
• The App is not a traditional dating platform and does not include swiping or photo/video sharing between users. A verification photo may be captured for liveness verification only, as described in the Privacy Policy, and that photo is never shown to other users.
• Users can discreetly send pre-composed messages to known connections to explore mutual feelings in a private and secure manner.

User Responsibilities

Account creation

• You are responsible for providing accurate and truthful account information.
• Phone number verification is required to create an account. Email is optional.
• You must keep your login credentials secure and not share them with others.
• You may optionally connect Snapchat through Snapchat's official API. wadaCrush validates the connection and stores the associated Snapchat profile URL or ID against your existing profile; connecting Snapchat does not create a separate wadaCrush account.

Appropriate use and known connections

You agree to use the App only for its intended purpose of fostering connections with people you already know. A "Connection" means someone with whom you have established rapport outside the App and who you can otherwise communicate with in person or online.

You may manually address a discreet crush to a known connection using their phone number, email address or Snapchat ID. By providing a crush's name or identifier, you confirm that you would otherwise be able to communicate with that person outside the App. wadaCrush acts as the processor used to facilitate your discreet message, and you are responsible for initiating the crush message.

Unresolved identifiers and message pipelines

If the recipient already has the exact phone number, email address or Snapchat ID linked to a wadaCrush profile, they may receive an in-app notification. If the recipient has not linked that specific identifier, the pipeline remains unresolved; no notification is sent at that point, and wadaCrush does not reveal whether the identifier exists on the platform.

If the recipient later links the matching identifier while the pipeline remains active, the pipeline may resolve and the recipient may then be notified. The sender still uses a credit when sending the message.

Behavior and moderation

You must not use wadaCrush for:

• Harassment, bullying or inappropriate behavior.
• Sending unsolicited messages or spam.
• Sharing or promoting explicit, violent or illegal content.
• Impersonating others or providing false information.

wadaCrush reserves the right to review, remove or moderate content at the message and profile level. A profile reported as abusive may be reviewed within 48 hours for compliance and may be removed without prior notice where the account violates these Terms.

Privacy & Data Security

• Global user search is not provided.
• Profiles of paired users may be viewable following a mutual pairing.
• Crush messages are pre-composed and anonymized before a mutual pairing.
• The App opens limited chat functionality only for paired users and encourages users to move to their preferred communication channel for further conversation.
• Personal information is shared between users only with mutual consent following a confirmed pairing.
• The App does not provide photo, video or other multimedia sharing between users.
• By using wadaCrush, you consent to the collection and use of information as described in the Privacy Policy.
• wadaCrush does not sell, rent or trade personal information. Limited information may be processed by trusted service providers strictly to operate core functionality, such as payment processing, SMS/email delivery, hosting and analytics, as described in the Privacy Policy.

Free & Premium Features

• The App offers access to applicable features using either free or premium credits.
• A crush sent using a free credit remains open for 7 days before expiring if unresolved. A crush sent using a premium credit remains open for up to 1 year.
• wadaCrush reserves the right to modify premium features and credit pricing at any time without prior notice.
• wadaCrush does not guarantee delivery of external crush notifications by SMS or email because delivery can be affected by country-specific rules, national do-not-disturb registries, carrier restrictions, recipient preferences and email spam filters.
• Purchases, including free and premium credit transactions where applicable, may be processed by third-party vendors. Investigation of failed transactions may take up to 14 business days.
• Users may transfer or donate eligible unused premium credits to a non-user or registered user. Transferred credits retain the same eligibility and expiry as the original credits, and there is no stated limit on transfer of ownership.
• Users may have a choice of payment gateway. Authorized third-party payment channels may offer different prices from App Store or Google Play. The base unit price is the price labeled for the equivalent purchase through App Store or Google Play in-app purchase.

Refunds and chargebacks

All purchases are final. Refunds are available only for qualifying technical failures directly caused by the App. Chargebacks or disputes with payment providers may result in account suspension while the matter is reviewed.

If an account is terminated for policy violations, access to paid credits may be lost and unused credits are not refundable.

Prohibited Activities

You agree not to engage in activities that:

• Violate local, national or international laws.
• Interfere with the App's operation, including hacking or malicious software.
• Exploit, harm or attempt to harm another user.
• Misuse content or data available in the App, including profile or personal information.
• Encourage or contribute to a harmful App environment through profane, insensitive, abusive or otherwise prohibited images or content.
• Groom, solicit, exploit or endanger a minor.
• Share, request or distribute child sexual abuse or exploitation material.

Intellectual Property

• All content, designs, logos and software related to wadaCrush/WhatTheCrush are the intellectual property of Yodha LLC or its licensors.
• Users may not copy, modify, distribute, reverse-engineer, decompile or sublicense any protected part of the App except where applicable law permits it. Legal action may follow where rights are violated.
• Applicable rights are owned by Yodha LLC, USA, and its subsidiaries as declared by the organization.

Termination of Use

wadaCrush reserves the right to suspend or terminate an account for violations of these Terms or applicable laws. Upon termination, access to the App and associated account data may be removed immediately, and the user may be restricted from creating another account where permitted by the platform's enforcement rules.

Permanent user-requested deletion

Account deletion is permanent. Once deletion is completed, personal account data, messages, uploaded contact data and stored verification photos associated with the deleted account are permanently removed from wadaCrush servers. Deleted profile data is not restored.

Creating a New Account After Deletion

Permanent deletion does not restore the prior account. If current product rules permit a returning user to register again, the user must create a new account using the phone number and, if applicable, email address they are eligible to use.

Under the current account rule described in this Terms draft, the same phone number (and linked email address, if applicable) may be used to create a new account after deletion up to a maximum of 3 times. Previously deleted profile data, messages, crush history and verification information are not restored.

Alias Identities

Users may add additional phone numbers, email addresses and their Snapchat ID as alias identities. This allows eligible messages received across linked identities to be consolidated into one wadaCrush account.

Users may add only identifiers they currently own. Misuse of an alias or primary identity may result in permanent account deletion.

Contact Upload

Users may voluntarily upload phone and email contacts to help identify existing connections on wadaCrush. No profile is created for an uploaded contact, and the uploaded contact is not notified merely because their information was uploaded.

Permission to access contacts remains active until the user turns it off in Settings. Uploaded contact data is never used for marketing and is never shared with third parties.

Users are responsible for uploading only contacts with whom they have a genuine real-life relationship consistent with the "Connections" definition in Section 3.

Profile Verification

Users may optionally verify their profile through a live photo captured within an on-screen guide. Verification is used to confirm that a real person is present at the time of capture and does not involve facial-recognition matching against other users, other photos or external databases. No biometric template is created or stored.

The verification photo is automatically screened for inappropriate or explicit content before a purple verification badge is applied. The photo itself is never displayed to other users; only the badge is visible. The photo is deleted when verification is turned off or when the account is deleted.

A verification badge does not constitute a guarantee or warranty by wadaCrush as to a user's identity, intentions or conduct.

Showcase & Referral Network

Showcase

Showcase is an optional feature that may suggest a user's anonymized profile to other compatible users. Showcase displays only age, gender and a compatibility score based on stated preferences and astrology. It never displays the user's name, profile photo, phone number, email address or Snapchat ID. Users may turn Showcase off at any time in Settings.

Referral network

Users may invite real-life connections to wadaCrush through their own external channels. Referrals are not delivered through wadaCrush's notification systems and do not themselves create in-app notifications.

When a referred user signs up using a referral link, both people may choose whether to remain connected in each other's referral network for Showcase purposes. With the relevant users' consent, Showcase visibility may extend through that referral network beyond direct referrals, without a fixed limit on the number of referral steps described in the current workflow.

Direct referrals are not shown as Showcase suggestions to the referrer. Users who have not opted their profile into Showcase are excluded from appearing to others in the network. Contact-based suggestions may also surface where the relevant users have uploaded contacts, opted into Showcase and have matching preferences.

Showcase and the referral network do not expose another user's phone number, email address or Snapchat ID; only the anonymized Showcase card is displayed.

Notifications & JoinTheQueue

• Users who opt in to receive notifications provide the applicable consent during sign-up or registration.
• By opting in, users agree to receive SMS and/or other non-marketing digital service messages from wadaCrush and related companies concerning discreet messages from known connections. Standard message and data rates may apply.
• To minimize notifications, wadaCrush may use SMS and email before a user signs up and prioritize in-app notifications after registration.
• Users may use available do-not-disturb controls such as blocking an individual contact or hibernating the account.
• The Nudge feature is limited to one notification before the applicable message expires.

JoinTheQueue

A person who does not want to create a wadaCrush account may choose to join JoinTheQueue by submitting a phone number, email address and/or Snapchat ID and consenting to receive an external notification if that identifier receives a discreet crush.

• No wadaCrush profile is created for a JoinTheQueue participant.
• Notifications are external only, such as SMS or email, because there is no App account to receive an in-app notification.
• Participants may opt out at any time using the private unique URL sent with an applicable SMS notification or the unsubscribe link in an email footer. The private link should not be shared with others.

Deleted accounts

Account deletion permanently removes the account and its associated account data, messages, uploaded contact data, verification photo and account-linked notification data from wadaCrush servers. Deleted account data is not restored.

Disclaimer of Liability

• The App is provided "as is" without warranties of any kind.
• To the extent permitted by applicable law, the App provider is not liable for data loss, security breaches, service interruptions or software errors. Use of the App is at the user's own risk.
• Users retain ownership of content they submit but grant wadaCrush a worldwide, non-exclusive, royalty-free license to use, distribute and modify that content as reasonably necessary for moderation and compliance.
• Users should take precautions such as using strong passwords.

wadaCrush/WhatTheCrush is not responsible for:

1. The accuracy or reliability of user-generated content.
2. Actions taken by other users.
3. Direct, indirect, incidental or consequential damages arising from use of the App to the extent such limitations are permitted by law.
4. Damages caused by external security breaches.

License Grant & Scope

The App is licensed, not sold, for personal use only. Users are granted a limited, revocable, non-exclusive and non-transferable right to use the App in accordance with these Terms.

Fair Use Policy

The license permits use of the App on a single device at a time. Simultaneous use on multiple devices or accounts is prohibited without explicit permission.

Third-Party Services & Integrations

wadaCrush integrates with third-party services, including Snapchat's official API for optional Snapchat account linking. wadaCrush is not responsible for the reliability or security of independent third-party services or for disputes caused by third-party failures.

Force Majeure

wadaCrush is not responsible for service disruptions caused by events beyond its reasonable control, including natural disasters, cyberattacks, government restrictions or infrastructure failures.

Indemnification

To the extent permitted by applicable law, users agree to compensate the App and owning company for legal claims resulting from their misuse of the service.

Explicit Third-Party Terms

By using applicable third-party functionality, users acknowledge that they may also be subject to the terms of App Store, Google Play, payment providers, Snapchat and other third-party providers.

Changes to These Terms & Software Updates

• wadaCrush reserves the right to update these Terms of Use at any time.
• The App may be updated automatically. Continued use after revised Terms or App updates become effective signifies acceptance where permitted by applicable law.

These Terms are governed by the laws of Wisconsin, USA. Any disputes shall be resolved through arbitration in Wisconsin, subject to any mandatory rights that apply under applicable law.

By using the App, you acknowledge that you have read, understood and agree to these Terms of Use.
