Welcome to WhatTheCrush, a.k.a. WadaCrush (referred to as "the App"). By downloading, accessing, or using the App, you agree to comply with and be bound by these Terms of Use.
If you do not agree to these terms, you may not use the App.
Safe pairing: Our platform ensures users can only message individuals they already know. Strangers or acquaintances can send discreet messages to users but cannot be read or paired unless the user knows their phone number or email address.
No Custom Messaging: To enhance safety and minimize disruptions, users cannot send personalized messages to their crushes. This restriction reduces annoyance and maintains a secure communication environment.
* The App is intended for individuals aged 18 and older.
* By using the App, you confirm that you meet the age requirement and have the legal capacity to agree to these terms.
* The App is designed to foster meaningful and organic relationships between known individuals.
* The App is not a dating platform, and it does not include swiping, photo sharing, or video sharing.
* Users can discreetly send messages to known connections to explore mutual feelings in a private and secure manner.
3.1 Account Creation
* You are responsible for providing accurate and truthful information when creating an account.
* You must keep your login credentials secure and not share them with others.
3.2 Appropriate Use
* You agree to use the App only for its intended purpose of fostering connections with people you already know.
Definition of “people you already know” (Connections): Someone you have established a rapport with outside the App, with access to them in person or online.
* By providing your crush’s personal information, such as their name, phone number, or email address, you confirm that you would otherwise communicate with the receiver outside the App. The App should only act as a processor of information.
* The App solicits your message to your crush on your behalf, and you are responsible for sending discreet crush messages.
* You understand that if the receiver has opted NOT to receive messages (e.g., blocked, hibernated or deleted their account), the App does not reveal this information to the sender to protect their privacy.
Note: In such cases, sender will still end up using a credit to send a message. Crush message remains in the pipeline until the receiver changes their account settings or the message expires.
3.3 You must not use the App for:
* Harassment, bullying, or inappropriate behavior.
* Sending unsolicited messages or spam.
* Sharing or promoting explicit, violent, or illegal content.
* Impersonating others or providing false information.
* App owns the right to remove, review, or moderate content at message and profile level
* A profile reported as Abusive will be reviewed with in 48 hours by the app to check their compliance with the app/company’s policy and may be taken down without communication with the account holder if the account holder violates the Terms of Use listed here.
* Global search feature is not provided in the application to save the privacy of the users.
* Profiles of only paired users can be viewed.
* Messages sent through the App to crushes are pre-composed and anonymized to protect your privacy.
* The App opens a chat window only for paired users and encourages them to move to their preferred messaging app for further communication.
* Personal information is shared only with mutual consent following a confirmed pairing.
* Once a mutual pairing is identified, the App allows limited chatting to encourage users to take the relationship offline.
* The App does not provide features for sharing photos, videos, or other multimedia content to ensure safety and privacy.
* By using the App, you consent to the collection and use of your data as described in the app/company’s Privacy Policy.
* Data may be shared with third parties possibly to carry out the functionality and accomplish better user-experience.
* The App offers access to all features when using either free or premium credits.
* Messages sent with free credits are short-lived, while those sent using premium credits remain active for longer durations.
* The App reserves the right to modify or update premium features and credit pricing at any time without prior notice.
* The app doesn’t guarantee the notification delivery of crush messages via external channels (email and SMS) due to the recipient country’s SMS and notification regulations. This may also include recipients preferences of receiving notifications which may include National DND registry or equivalent in various countries and email spam filters.
* All purchases, both Free and Premium (credits) are processed via third party vendors and would require additional investigation for failed transactions which may take up to 14 business days.
* User may transfer/donate their unused premium credits to a non-user or registered user, which carries the same eligibility and expiry as per the original credits. There is no limit on transfer of ownership.
* User deserves the choice to choose the payment gateway, which may offer discounted prices when credits or subscriptions of same nature are purchased via third party vendors compared to the App store or Play Store. Base price of the unit is always defined as the price labeled when purchased via App Store or Play Store payment gateways (in app purchase).
* Refund Policy & Chargebacks: All purchases are final. Refunds are only available in cases of technical failure directly caused by the App. Chargebacks or disputes with payment providers may result in account suspension.
* If an account is terminated due to policy violations, will users lose access to paid credits. Refunds for unused credits are not provided.
You agree not to engage in activities that:
* Violate local, national, or international laws.
* Interfere with the App's operation, such as hacking or introducing malicious software.
* Exploit, harm, or attempt to harm other users.
* Misuse any content or data available in the App, including profile images or personal information.
* All content, designs, logos, and software related to the App are the intellectual property of WhatTheCrush or its licensors.
* Users may not copy, modify, distribute, reverse-engineer, decompile or sublicense any part of the App. Penalties or legal actions will imply, if violated.
* All rights are owned by Yodha LLC, USA and its subsidiaries in various countries as declared by the organization, Yodha LLC
* The App reserves the right to suspend or terminate your account at any time for violations of these Terms of Use or any applicable laws.
* Upon termination, users’ access to the App and all associated data may be removed immediately. Users will be restricted to re-open the account.
* Upon termination, user can reopen the account with same email address for a maximum of 3 times.
* User can add their additional phone numbers and email addresses as aliases which consolidates messages received from their connections into one account. However, users must only use their identities that they currently own. Any misuse of alias and primary identities will lead to permanent deletion of account.
* Users who’d like to opt in to receive notifications, should tick the box during registration.
* By checking the box, users agree to receive SMS and/or other digital forms of non-marketing messages from WadaCrush and related companies to notify about discreet messages received from their known connections. Standard message and data rates may apply. Users can opt-out anytime laters in Settings page.
* To minimize the amount of notifications received by the users, the App only sends notifications as SMS and emails until they sign up. Upon registration, users only receive in-app notifications
* Users can go into Do-Not-Disturb mode by either blocking an individual contact within the chat window, or by choosing hibernate option in the Settings
* Deletion of an account may not stop SMS and email notifications from new connections
* To avoid spamming, Nudge feature has been limited to send notifications just once before the message expires
* The App is provided "as is" without warranties of any kind.
* The App provider is not liable for any data loss, security breaches, service interruptions, or software errors. Use of the App is at users’ own risk.
* Users retain ownership of content they submit but grant the App a worldwide, non-exclusive, royalty-free license to use, distribute, and modify content as necessary for moderation and compliance.
* Users should take precautions, such as using strong passwords.
* WhatTheCrush is not responsible for:
- The accuracy or reliability of user-generated content.
- Actions taken by other users.
- Any direct, indirect, incidental, or consequential damages arising from your use of the App.
- Damages caused by external security breaches.
This App is licensed, not sold, to you for personal use only. You are granted a limited, revocable, non-exclusive, and non-transferable right to use the App in accordance with these Terms.
This license allows use of the App on a single device at a time. Use of the App on multiple devices or accounts simultaneously is prohibited without explicit permission.
The App integrates with third-party services. We are not responsible for their reliability, security, or any disputes arising from third-party failures.
We are not responsible for service disruptions caused by events beyond our control, including but not limited to natural disasters, cyberattacks, government restrictions, or infrastructure failures.
Users agree to compensate the app/company for any legal claims resulting from their misuse.
By using the app, users acknowledge that they agree to third-party terms (App Store, Google Play, payment providers etc).
* WhatTheCrush reserves the right to update these Terms of Use at any time and publish it on our Terms webpage and App link.
* The App may be updated automatically. Continued use of the App after an update signifies acceptance of new terms and features.

These Terms are governed by the laws of Wisconsin, USA. Any disputes shall be resolved through arbitration in Wisconsin.
